SDS-CBI, translation and fabrication for SDS and GHS

The United Nations Transport of Dangerous Goods and the Globally Harmonized System Committee of Experts indicated (UNCETDG / GHS) to complete the development of Globally Harmonized System of Classification and Labelling of Chemicals (GHS) in December 2002. In the meeting of the United Nations Economic and Social Commission in July 2003 formally adopted GHS and authorized its translation into the official languages of the United Nations to facilitate the worldwide use, and update every two years, as 2021 has been updated to Version 9. The EU, United States, Canada, Taiwan, Japan, Korea, China, Brazil, the world's major countries and regions have been gradually implemented GHS. Meanwhile, the country-specific requirements for other languages or regulations detail levels, therefore required for production of safety data sheets for different countries.

Hazardous chemicals which are consistent with national standards CNS15030 classification has Physical hazard, Health hazard or Environmental hazard. Classification and labeling of chemicals took effect on January 1st 2016 in Taiwan. The full implementation of GHS to implement chemical hazard classification and labeling and with the international standards, preparation of chemicals should be labeled and made of SDS, aim to provide users with the use of chemicals for safety information, in order to facilitate the overall understanding of chemical hazards and safe use information to use when take appropriate protective measures, respectively. The Material Safety Data Sheets (MSDS) has been changed to Safety Data Sheet (SDS).

According to Article 10 of the “Occupational Safety and Health Act” - the employer for hazardous chemicals should be label, inventory preparation and reveal safety data sheets and take the necessary measures through knowledge. The manufacturer, importer or supplier, providing chemicals in the preceding paragraph and before institutions or self-employed persons, shall be marked and provide safety data sheets. The branched law “Regulations for the Labeling and Hazard Communication of Hazardous” Chemicals Article 15: Manufacturers, importers, suppliers, or employers shall check the accuracy of a Safety Data Sheet (SDS) based on the actual circumstances and update it as needed. A Safety Data Sheet shall be reviewed at least once every three years. Related penalties based on Occupational Safety and Health Act Section 43 – noticed by the improvement deadline, if fail to make improvements will be fined more than NT $ 30,000 to 300,000.

DG’s Service Items:

Safety Data Sheet (SDS) Translation 

1. Translation SDS from English or Japanese into Traditional Chinese to compliance with regulatory requirements in Taiwan.

2. Prepare labels in accordance with GHS for customers.

3. Compliance assessment

A. Cover letter with domestic and international compliance confirmation for the translation SDS.

B. Check list: Chemical Regulatory Status result.

C. Basic research: Chemical Regulatory Status result and insufficient part of terms.

D. Analysis: Chemical Regulatory Status result. insufficient part of terms and compliance suggestion.

Safety Data Sheet Information Withholding (SDS-CBI)

In response to the need for trade secret protection by the manufacturer, importer or supplier, the Ministry of Labor provides SDS-CBI to protect:

1. Name of hazardous chemical ingredient

2. CAS number of hazardous chemical ingredient

3. Concentration of hazardous chemical ingredient

4. Name of manufacturer, importer, or supplier

 

If the applicant is a foreign manufacturer, entrust DG as TPR for the SDS-CBI application is necessary.

However, chemical ingredients possessing the following hazards as specified in below shall not apply for the Safety Data Sheet disclosure.

A. Chemical substance list in “Standards of Permissible Exposure Limits at Job Site”.

B. CNS15030 Classification as:

(a) Acute toxicity category 1, category 2, or category 3

(b) Skin corrosion/irritation category 1.

(c) Serious eye damage/eye irritation category 1.

(d) Respiratory or skin sensitization.

(e) Germ cells mutagenicity.

(f) Carcinogenicity.

(g) Reproductive toxicity.

(h) Specific target organ systemic toxicity -- single exposure category 1.

(i) Specific target organ systemic toxicity-- repeated exposure category 1.

C. Other list specified by the central competent authority.
